Administrative Law
Advice on government decisions, permit refusals, objections and administrative appeals in Curaçao.
Has a government decision affected your home or business?
A refused permit, an unexpected condition or a delayed application can interrupt a business opening, a building project or a personal move. The first task is to identify the decision, the authority responsible and the deadline for responding.
ZL Attorneys advises individuals and businesses on dealings with government and disputes arising from them. Our governmental matters practice covers applications and regulatory requirements; this page explains what to consider when a decision needs to be challenged.
If you have received a decision, seek advice promptly. Keep the decision and evidence of when it was sent or delivered. Do not wait for an informal conversation with an official before checking your legal options.
How administrative challenges work in Curaçao
The Landsverordening administratieve rechtspraak, commonly called the LAR, provides a route to challenge certain individual public-law decisions. It is not the procedure for every disagreement with government. The type of decision, your interest in it and any special legislation determine the route.
Under article 16, the ordinary LAR appeal period is six weeks after the decision is given or deemed refused; dispatch or delivery matters to that calculation. Articles 55–56 address an objection to the authority. Article 85 allows a request for suspension or another interim measure where implementation would cause disproportionate disadvantage. These are distinct steps, not interchangeable complaints. See the LAR, particularly articles 3, 7, 16, 55–56 and 85 (Dutch).
We check which procedure applies before advising whether to seek reconsideration, file an appeal or request urgent protection. A missing reply also needs assessment: the application history and the applicable decision period matter.
What we can help you prepare
- A clear account of the application, decision and practical consequences.
- The factual and legal grounds for challenging a refusal or condition.
- An objection or appeal and the documents supporting it.
- Evidence of urgency, such as an imminent closure or interruption to operations.
- Responses to the authority's position and preparation for a hearing.
The Joint Court's Curaçao information page publishes procedural information and the administrative litigation rules. We explain the relevant steps in plain language and discuss costs and scope before proceeding.
What to have ready for your lawyer
Gather the complete decision, its envelope or delivery email, the original application, submitted attachments and subsequent correspondence. Add a short timeline with exact dates and a note explaining what you want to achieve.
For a company, identify the applicant, its directors and the person authorized to instruct us. If a project or business is affected, explain any immediate commercial consequences. Keep these documents available; start your enquiry with a short description rather than sending a large or sensitive file through the contact form.
Questions clients ask
Can I continue operating while I challenge a refusal?
Do not assume that submitting a challenge gives permission to continue. We need to check the decision, existing permissions and whether interim relief is necessary. Explain any imminent enforcement action at the first contact.
Is speaking to the authority enough to protect my position?
An informal discussion may help resolve an issue, but it should not be relied on to protect a filing deadline. Keep written records and have the formal route checked alongside any discussions.
Can you assist if I am outside Curaçao?
We can start by discussing the matter remotely. Representation, documents, translation and any attendance requirements are assessed for the particular procedure.
Discuss the decision with ZL Attorneys
Our government-facing work connects with corporate law, permits and litigation. That allows us to consider both the decision itself and its effect on the business or person involved.
Contact us with the authority's name, the decision date, any stated deadline and a brief description of the issue. This is general procedural information; the correct route depends on your documents and circumstances.
