Employee dismissal in Curaçao requires a review of the employment relationship, the reason for termination and the correct legal route before action is taken. An employer should not assume that paying notice makes a dismissal valid. An employee should not assume that a termination letter or settlement proposal must be accepted immediately.
The useful first step for either side is the same: assemble the contract and a dated account of what happened. That allows an adviser to identify the available options, any urgent response needed and the financial issues to resolve.
Establish which rules apply to the relationship
Start with the employer's identity, the employee's role, the place of work and the contract history. A private-sector employee, a statutory director and someone working in public service may require different analysis. A current fixed-term document may also sit within a longer sequence of agreements.
The Curaçao dismissal ordinance contains a prohibition on employer termination without the relevant permission, together with exceptions and rules on its scope. Exceptions include specified circumstances involving mutual agreement, probation, urgent cause and the expiry of a fixed-term contract. Whether an exception applies requires examination of the facts and contract history. See the official consolidated dismissal ordinance.
ZL Attorneys' employment law practice advises both employers and employees on contracts, dismissal and workplace disputes. Explain the circumstances before selecting a procedure or signing a document.
Separate the business problem from the proposed solution
Suppose a company wants to dismiss a manager after missed sales targets. Its records also show that the territory changed, stock shortages affected sales and no revised targets were agreed. That file raises different questions from a documented incident of serious misconduct.
For an employer, the preparation should identify:
- The actual reason the relationship may need to end.
- The evidence supporting that reason.
- The employee's explanation and relevant correspondence.
- Previous warnings, reviews, support or proposed changes.
- Any sickness, leave, collective arrangement or other circumstance requiring specific review.
- Alternatives considered and the operational consequences of each.
Do not improve the file by rewriting history. Preserve original communications and distinguish contemporaneous records from a summary prepared later. For an employee, the same chronology helps identify omissions, misunderstandings and evidence that supports a challenge.
Compare the possible termination routes
The Court's Curaçao guidance describes the SOAW dismissal-permit route, court dissolution proceedings, challenges to dismissal and termination for an urgent reason. It also explains that employers and employees can bring employment disputes before the court. Those options do not make every route suitable for every dispute. Curaçao Court employment-case guidance.
Ask counsel to explain the practical consequences of the proposed route: the evidence needed, the likely issues in dispute, the handling of work and salary while it proceeds, and the basis for the proposed end date. Get advice before communicating an irreversible decision.
A negotiated departure
A settlement may allow the parties to agree an orderly exit. Its value depends on the whole agreement, including payment, timing and the rights being resolved. Both sides need a clear understanding of the draft and an opportunity to take advice.
A contested termination
If agreement is unavailable, prepare for a procedure with a coherent factual file. Keep correspondence professional and consistent with the legal position. The firm's litigation team can assess a dispute and any need for urgent court action.
An allegation of serious misconduct
Immediate dismissal carries particular risk. A troubling allegation is not a substitute for analysis of the legal requirements, evidence and timing. Seek prompt advice on investigation and communication rather than treating a template dismissal letter as the next automatic step.
Calculate the financial position in separate parts
A departure proposal should make clear what each amount represents. Distinguish ordinary payroll items, notice-related questions, any statutory entitlement and a separately negotiated settlement payment. A single unexplained figure makes it difficult for either side to evaluate the offer.
Check salary records, leave balances, commission terms, approved expenses, pension arrangements and benefits. Establish the proposed treatment of equipment, loans, housing or other arrangements linked to employment. Payroll and legal advisers should work from the same assumptions.
Cessantia is a distinct issue. SVB describes a statutory one-time benefit for qualifying employment endings outside the employee's fault, subject to the scheme's scope and conditions. Eligibility, the wage basis and service history need review; a negotiated amount should not obscure whether this issue has been addressed. SVB's cessantia guidance.
Review the settlement beyond the payment
For an employer, the agreement should be workable for payroll, management and IT. For an employee, it should clearly describe the promises made and the rights being released.
Use this checklist when reviewing the draft:
- What is the agreed end date, and what happens until then?
- Which payments are itemised, and when are they due?
- How are benefits, outstanding expenses and company property handled?
- What wording governs references and internal announcements?
- Which confidentiality or other continuing obligations remain?
- What claims are settled, and are any matters expressly left open?
- Who signs, and what must each party do after signature?
If several jobs may be affected, individual settlement drafting is only part of the work. ZL Attorneys' labor law practice also supports workforce restructuring, redundancy planning and collective labor matters.

Questions about dismissal in Curaçao
Can an employer simply give notice?
Do not assume so. The contract, applicable protections and proposed route must be checked before notice is given. Notice and permission to terminate are separate issues in the analysis.
What should an employee do after receiving a dismissal letter?
Keep the letter, contract, payslips and relevant messages, and seek advice promptly. Record when and how the decision was communicated. Any response deadline depends on the action and remedy involved.
Is there a standard settlement amount?
There is no reliable universal figure for evaluating every departure. Separate any statutory entitlement from negotiated compensation and assess the circumstances, evidence and terms of the proposed agreement.
